CLOUDWARD PRIVACY POLICY

Cloudward, Inc. and its divisions, affiliates and subsidiaries ("Cloudward") respect the privacy and the integrity of any information that you provide us as a user of this Cloudward.com and EASE-Installer.com (“Sites”).

1. APPLICATION OF THIS POLICY

This Privacy Policy applies to all domains owned and operated by Cloudward, Inc. (collectively referred to in this Policy as the Cloudward Web Site(s) and or Site(s)). It will tell you how and why we gather information about you.

These Site(s) are connected by "hyperlinks" to other Web sites, including Web sites owned and/or operated by Cloudward partners offering products or services in the Cloudward Cloudward™. We are not responsible in any way for the privacy practices on other Web sites and suggest that you review the privacy policies on those linked Websites before using them.

2. WE ARE ACCOUNTABLE TO YOU

We have designated an officer of the company to be accountable for our policies and practices with respect to the management of information that is gathered about your use of the Site(s). Any questions, comments or complaints that you might have about our privacy practices should be forwarded in writing to:

3. COLLECTION OF INFORMATION

Personally identifiable information or personal information is defined as information that identifies you, as an individual, or an organization, and includes your name, company name, address, telephone number, email address, and financial qualification and billing information.

We only collect personally identifiable information about you after you have specifically and knowingly provided such information to us. By voluntarily providing this information to us at various points when using our Site(s), including but not limited to: sending us a comment or suggestion; deploying an application from the Site; generating data in the course of using an application on the SIte; entering a chat room or bulletin board; downloading content; or entering a contest that is posted on our Site(s), you will be consenting to the collection and use of your personal information by us for that online activity. You are under no obligation to provide us with this information and can access many aspects of the Site(s) without providing us any personal information.

4. THE PURPOSE OF OUR COLLECTING INFORMATION FROM YOU

If you visit our Site(s), or participate in an online activity, your personal information will only be used for the purposes of that online activity, unless you otherwise provide us with your consent. The following examples are illustrative of these purposes and are not the only circumstances under which we would collect and use personal information:

  • To respond to your questions, or comments you forward to us.
  • To run chat rooms, bulletin boards or other areas of interaction with other members.
  • To contact you to discuss your use of the Site(s).
  • To provide requested information to you such as a password or to provide technical or customer support.
  • To view or access for the purpose of resolving a problem, support issue, or suspected violation of the Cloudward or Licensing Agreements, or as may be required by law.
  • To diagnose technical problems, and to administer our Site(s) in order to constantly improve the quality of the Site(s).
  • To keep aggregate information on Site use.

When you initially use, subscribe to, purchase Content or Offerings from the Cloudward, or communicate within the Cloudward, you will be asked to register with the Cloudward, setup a Cloudward Account, and accept this Agreement. In the registration process, you will be asked to provide accurate contact information, such as name, company name (if applicable), address, phone number, and email address, and financial qualification and billing information, such as billing name and address, and credit card number.

Additionally, at the time that you initially register and setup your Cloudward Account, you may be asked whether or not you wish to receive marketing and other non-critical Service-related communications from Cloudward and its partners from time to time. You may opt out of receiving such communications at that time or at any subsequent time by changing your preferences by logging into your Account and returning to the registration process. Once you have returned to the registration process, you can update or remove information at any time by logging into the Website and editing your Personal Information within Setup. You can view your updated profile to confirm your edits have been made.

When you use, subscribe to or purchases Content or Offerings from the Cloudward, you consent to have identifying information relayed to the 3rd party owner or operator providing you with the software or services provided on the Sites identifying the you as a user/subscriber/purchaser of the particular Content or Offering. Cloudward will not provide financial qualification information to a 3rd party without your Consent or unless it is specified in the subscription, merchant account application or purchase agreement with the 3rd party.

PLEASE TAKE NOTICE that because the Cloudward and the Offerings or Content that you will use, purchase or subscribe to are hosted, online applications, Cloudward and its partners occasionally may need to notify you about the Cloudward or the Particular Offerings and Content (whether or not you have opted out as described above) of important announcements regarding the operation of the Cloudward, Offerings and Content.

All financial and billing information that we collect from you is used solely to check your qualifications as a prospective customer, and to bill for transactions that you have agreed and entered into.

5. DISCLOSURE OF YOUR PERSONAL INFORMATION

We will not sell or rent your personal information to any other party without your consent. However, we may disclose your personal information in the circumstances set out below.

If you have entered into and won one of our contests, your name and city of residence may be published by us or one of the sponsors. Please check the specific contest rules for details.

We may also be required by law to disclose personal information without your consent in the event of emergency situations or when required by government or other legal authority.

We may also disclose personal information to third parties in connection with a corporate reorganization, merger or amalgamation, or the sale of all or substantially all of our assets, provided that the personal information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring this information.

Please be advised that when you voluntarily disclose information on the bulletin boards or in the forum or chat areas of our Site(s), your personal and other information disclosed in your communication shall become public information and can be collected and used by other parties. We cannot control what third parties in the bulletin board or chat room do with your personal information.

6. NON-PERSONAL INFORMATION

In addition, we collect non-personally identifiable information, which is information that does not identify you personally, but becomes available to us as a result of your visit to our Site(s). This information includes; your IP address, a number automatically assigned your computer when you visit the Site(s); your Internet Service Provider; and your Web Browser.

One way we use this non-personal information is as a diagnostic and administrative tool for identifying system problems, administering the Site(s), and providing variable content. Much of this is done through the use cookies on the Site(s). Cookies are small text files that your web browser leaves on your hard drive to recognize you as a repeat user of our Site(s). If you do not want cookies to be used, you should access the features of your web browser for the procedure to disable the cookies.

We collect personal and non-personal information in a non-identifying, anonymous and aggregate form to enhance our Site(s) design, to share with advertisers, and for statistical purposes. These statistics and reports will contain only aggregated and no personally identifiable information.

7. WHEN DISCLOSURE IS REQUIRED & EUROPEAN UNION RESIDENTS

We cannot ensure that your private communications and other personally identifiable information will not be disclosed to third parties. For example, we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, we can (and you authorize us to) disclose any information about you to private entities, law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate to investigate or resolve possible problems or inquiries.

For persons in European Union countries, terms such as "personal information" refer to "personal data" as defined by the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (the "Directive"). We will not collect any personal data from you unless you provide it voluntarily by providing us with your freely given specific and informed consent. You acknowledge and agree that we may transfer such information (including, without limitation your personally identifiable information or personal data) to the United States or other countries or may share such information with our licensees and agents in connection with the Site(s); you should be aware that different laws and/or regulations may apply outside the European Union with respect to your personal data. Furthermore, if you request any technical support, you consent to remote accessing and review of the computer you load the Software onto for purposes of support and debugging.

8. SAFEGUARDS WE HAVE IN PLACE

We employ reasonable managerial and technical measures to ensure that your information is secure. For example, all personally identifiable information is maintained behind a firewall. In addition, Cloudward uses server authentication, data encryption, encoded session identifications, and other advanced technology to prevent interference or unauthorized access from outside intruders.

9. CHILDREN

Minors in the country, state or province in which they live, may only use the Site(s) with the approval of a parent or guardian.

10. CHANGES TO THIS PRIVACY POLICY

We may change this policy as new services are added or old ones are changed. Such changes will be effective when a notice of the change is posted on the Site(s). Please check this Privacy Policy from time to time for updates by checking the date of the "Last Update" at the top of this document.

11. OPT-OUT POLICY

If, at any time after you have provided information to us, and you have changed your mind about receiving information from us or about sharing your information, then you can either return to account setup and change your preferences or send us an email that specifies your request.
